1. WHAT DOES THIS PRIVACY NOTICE TELL YOU?
This Privacy Notice tells you how adidas collects and uses the information you provide us which can be used to identify you directly or indirectly (“ Personal Data”) when you participate in the adidas for Prada re-source NFT Project 2022 (“the Project”).
2. WHO IS RESPONSIBLE FOR YOUR PERSONAL DATA (“ADIDAS JOINT CONTROLLERS”)?
adidas AG (“adidas”) (Adi-Dassler Str. 1, 91074 Herzogenaurach, Germany ) is responsible for compliance with applicable privacy laws ( including the EU General Data Protection Regulation) for the purposes described in this Notice.
3. WHAT DOES ADIDAS DO WITH YOUR PERSONAL DATA AND WHY (CATEGORIES OF PERSONAL DATA, PURPOSE, PROCESSING, LEGAL BASIS)?

In order to verify your eligibility to enter the Project and comply with the Project Terms and Conditions (“T&Cs”), we need to connect to your crypto wallet as specified in the T&Cs. You will submit your Image Tile as defined in the T&Cs and under “What Should I Create for My Image Tile?” on the Site: www.adidas.com/prada-nft to adidas.
For the purposes identified in this Privacy Notice, adidas does not collect any Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or any files which may contain genetic data, or biometric data for the purpose of uniquely identifying a natural person, or data concerning health or a natural person's sex life or sexual orientation. Where your Image Tile contains any of the information or data listed above, we will delete your Image Tile immediately.
Your Image Tile will be processed by Chainlink (blockchain technology) in order for us to randomly select Winning Image Tiles. Winning Image Tiles will be blurred or puzzled or otherwise modified and reformatted to become the Tile Image NFT. We will also review your Submission to ensure compliance with our terms and conditions and that the submission is in line with community guidelines.
§ HOW LONG WILL WE BE KEEPING YOUR PERSONAL DATA? (“RETENTION PERIOD”)
If your Image Tile did not become a Winning Image Tile, your Personal Data will be deleted within 48 hours.
Where your Image Tile becomes a Winning Image Tile and a Tile Image NFT, we will transfer the Tile Image NFT to your Cryptowallet. The Tile Image NFT and the NFT Artwork which contains your Tile Image NFT will also be stored in the InterPlanetary File System (“IPFS” - blockchain) permanently. It will not be deleted by adidas as it is required for the purpose of compliance wit the T&Cs, and adidas does not have means to delete files stored on the IPFS.
§ WHO DO WE SHARE YOUR PERSONAL DATA WITH? (“CATEGORIES OF RECIPIENTS”)

4. WHAT HAPPENS WHEN ADIDAS TRANSFERS YOUR PERSONAL DATA OUTSIDE YOUR COUNTRY OF RESIDENCE?
adidas may need to share your Personal Data with other companies to complete the purpose and the processing of your Personal Data described in this Privacy Notice. Where the other companies are located outside or your country of residence, or outside the EU/EEA, adidas will make sure your Personal Data is protected in accordance with the laws of your country of residence even when it has been transferred abroad.
To be more specific, we implement the following measures: a) contracts; b) information security controls; and c) organisational privacy standards and processes. More details provided in “5. HOW DO WE SECURE YOUR PERSONAL DATA?”.
5. HOW DO WE SECURE YOUR PERSONAL DATA?
A) CONTRACTS
adidas concludes appropriate contracts and/or contractual clauses to ensure the privacy standard we established is maintained when we share your Personal Data with other adidas and third-party companies located within or outside your country of residence. This includes: inter-company agreements, data processing agreements, data transfer agreements or data privacy clauses approved by regulatory authorities such as the EU Standard Contractual Clauses approved by the EU Commission.
B) INFORMATION SECURITY CONTROLS
adidas has sufficient information security controls to address the risks and the impacts corresponding to our use of your Personal Data, including loss, alteration, or unauthorised access to your Personal Data as a result of malicious intent (hacking) or negligence (human error).
Please be aware that any transmission of your Personal Data through the internet is at your own risk. We can only protect your Personal Data once we have access to it.
C) ORGANISATIONAL STANDARD AND PROCESSES
adidas has privacy standard and processes in place to ensure necessary privacy impact assessments are completed before we collect and process any Personal Data, as well as processes to ensure compliance with privacy legal requirements and to enable you to exercise your rights under the law.
6. WHAT ARE YOUR RIGHTS AND HOW CAN YOU EXERCISE THEM?
Depending on your country of residence, you may have the following rights to your Personal Data: a) right to delete your personal data; b) right to access your personal data; c) right to correct your personal data; d) right to object to direct marketing and commercial messages; and e) right to withdraw your consent.
If you are located in a EU/EEA country, Switzerland, and the UK, you have the following rights specifically under the EU GDPR:
§ ACCESS YOUR PERSONAL DATA
Your Image Tile will be deleted after 48 hours of submission if it is not selected to be minted as a Tile Image NFT. If you wish to access your Tile Image NFT, it will be stored on the IPFS as well as your crypto wallet. adidas does not store it in our systems separately.
§ MAKE SURE YOUR PERSONAL DATA ARE CORRECT
§ DELETE YOUR PERSONAL DATA
Your Image Tile and Tile Image NFT will not be deleted with your request as it is required by the contract. Please refer to the NFT Project T&Cs.
§ RESTRICT HOW WE USE YOUR PERSONAL DATA

NFT Project 2022 - Just In Time Privacy Notice
PRIVACY
In order to process your request to participate in the adidas for Prada re-source NFT Project 2022 (“the Project”) and verify compliance with our Terms and Conditions (“T&Cs”), adidas AG (“ adidas”, “we”, “us”) will connect to your crypto wallet, access your Image Tile, process your Image Tile using Chainlink to select a winner, modify your Image Tile to create a Tile Image NFT in accordance with the T&Cs and the instructions provided in the FAQs. Your Image Tile will be deleted after 48 hours if it is not selected to become a Tile Image NFT. A Tile Image NFT will be stored permanently on the InterPlanetary File System (“ IPFS”) for your access. For the purpose of performing our obligations and rights under the T&Cs, adidas cannot delete your Personal Data associated with the Project.

By participating in the Project, you have read and understood rights and how adidas uses your data as detailed in the Privacy Notice above.
